Welcome to SpineLab! The terms "we", "us", and "our" refer to SpineLab. SpineLab operates this store and website, including all relevant information, content, features, tools, products, and services within the order, to provide you (the customer) with a carefully curated shopping experience (the "Service"). SpineLab is powered by Shopify, which allows us to provide the Service to you.

When you place an order, you are making an offer to purchase. SpineLab reserves the right, at its sole discretion, to accept or reject your order for any reason. Your order is not considered final until SpineLab confirms acceptance. Your order will only be accepted after we receive and process your payment. Please review your order carefully before submitting it; once an order is accepted, SpineLab may not be able to accommodate cancellation requests. If we do not accept, or if we change or cancel an order, we may attempt to notify you by contacting the email, billing address, and/or phone number provided at the time the order was made. 
Your purchases may only be returned or exchanged in accordance with our Refund Policy [Link]. 
You represent and warrant that your purchases are for personal or household use only and are not for commercial resale or export.

Section 4 - Pricing and Billing
Prices, discounts, and promotions are subject to change without notice. The price of a product or service is the price in effect at the time the order is placed and will be detailed in your order confirmation email. Unless explicitly stated otherwise, the prices displayed do not include taxes, shipping, handling, duties, or import fees. 
Prices posted in our online store may differ from prices in physical stores, third-party operated online stores, or other locations. Section 5 - Shipping and Delivery
We assume no responsibility for shipping and delivery delays. All delivery times are estimates only and cannot be guaranteed. We are not liable for delays caused by carriers, customs processing, or circumstances beyond our control. Once we hand the product over to the carrier, title and the risk of loss transfer to you.

You must not use such marks without the prior written permission of SpineLab. Shopify’s name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans appearing in the Service are the trademarks of their respective owners.

Section 7 - Optional Tools
We may provide you with access to third-party customer tools as part of the Service over which we neither monitor nor have any control nor input. 
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

You further agree that your Feedback will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. Additionally, you agree not to: (1) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service; (2) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Service; (3) collect or track the personal information of others; (4) spam, phish, pharm, pretext, spider, crawl, or scrape; (5) use any robot, spider, scraper, data harvesting or extraction tools, automated devices or processes, AI tools (e.g., agentic AI), or automated or manual means to access the Service; or (6) interfere with, bypass, or circumvent the security features, authorization mechanisms, robot exclusion headers, or other measures we use to restrict access to the Service. To the maximum extent permitted by law, in no case shall SpineLab, our partners, directors, officers, employees, affiliates, agents, contractors, service providers or licensors, as well as Shopify and its affiliates, be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.

You agree to indemnify, defend and hold harmless SpineLab, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers, from any losses, damages, liabilities, or claims made by any third-party (including reasonable attorneys’ fees), due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference; (2) your violation of any law or the rights of a third-party; or (3) your access to and use of the Service. 
We will notify you of any claim requiring indemnification, but failure to promptly provide notice will not relieve you of your indemnification obligations unless you are materially prejudiced thereby. We may assume control of the defense and settlement of such claims at your expense, including the choice of counsel, but we will not settle any claim requiring you to incur non-monetary obligations without your consent (which you will not unreasonably withhold). You shall cooperate in the defense of any indemnifiable claim, including providing relevant documents.
